Employees are entitled to paid sick leave under Maltese law, typically supported by medical certificates. Employees may also be eligible to receive employment sick benefits (paid through the social security system).

Currently, the number of days to which an employee may be entitled to paid sick leave will vary depending on the sector/industry in which the employer operates, which must be assessed on a case-by-case basis. If work activity is not explicitly regulated by a sector-specific Wage Regulation Order, the sick leave entitlement of an employee will amount to two working weeks per year calculated in hours.

An employee cannot be dismissed immediately merely for using all paid sick leave. Managing long-term illness requires careful policies, which can reduce absences, boost morale, and lower costs. Indeed, depending on the circumstances a long term illness may lead to termination, and absence abuse may lead to discipline and, if necessary, dismissal.  

Clear policies help employers manage absence, outlining what is expected of employees if they need to be absent, including reporting of unplanned absences, as well as an obligation to remain in touch during absences. Managers need to be trained to know how to be consistent and fair, yet apply the rules in a consistent manner, handling personal data attentively.

Employers must also be prepared to understand the different obligations arising out of sickness, as opposed to leave arising out of work-related accidents, as well as additional obligations that arise when an employee has a disability.
