Tribunal Decision – Ivan Camilleri V Allied Newspapers Ltd

The case Ivan Camilleri vs Allied Malta Newspapers plc essentially highlighted that incidents outside work and personal character of the individual might have relevance when determining whether an employee ought to be dismissed. However, not all incidents outside work will justify a dismissal. The Tribunal emphasised that the incidents must have a link with the employment, and that as with all other cases of dismissal, there is an expectation for the employee to be given an opportunity to defend himself against accusations, as well as to know what evidence is being used against him. Anonymous hearsay evidence will not quite cut it.
The Tribunal decided that Mr. Camilleri was unjustly terminated and awarded him €171,569 in compensation. The decision has been appealed, and the outcome is pending. This insight has been updated after the appeal decision was published on the 12th February 2025. Read more about this here.
