Hot News! New Law on Employee Rights and Pay Transparency Now in Effect

As of the 27th August 2025, employees in Malta have been given two new explicit rights:
- Job Applicants have the right to receive, before commencement of a new job, their prospective wage, or its range, and where applicable, the relevant pay provisions of the collective agreement.
- Employees have the right to request, at any time during their employment, (i) their individual pay level, and (ii) the pay levels for categories of workers who perform the ‘same work’ as them.
The employer must provide the information upon written request within a reasonable period of time but in any event not exceeding 2 months from the request.
This is one step closer to the transposition of the full range of obligations arising out of the EU Pay Transparency Directive. The Directive is to be transposed full in Malta by June 2026, and this should further extend the employees’ right to receive pay-related information for comparable categories of workers who might not perform the ‘same work’ but who perform ‘work of equal value’.
NOTE: understanding which jobs are comparable because they have ‘equal value’ requires careful assessment, justified on the basis of objective, gender-neutral, and non-discriminatory criteria.
